In order to streamline procedures and improve efficiency in the management of bonded goods circulation, and in accordance with the "Customs Law of the People's Republic of China" and relevant laws and regulations, the General Administration of Customs aims to optimize management and services, enhance the level of information management, and promote the application of the Special Supervision Area Management System and the Bonded Logistics Management System. The following matters regarding the management of bonded goods circulation (equipment transfer) in Customs Special Supervision Areas and Bonded Logistics Centers (Type B) are hereby announced:
I. After establishing bonded sub-accounts in the Special Supervision Area Management System and the Bonded Logistics Management System, enterprises shall follow this announcement for the management of bonded goods circulation (equipment transfer) transactions between Customs Special Supervision Areas, between Customs Special Supervision Areas and Bonded Logistics Centers (Type B), and between Bonded Logistics Centers (Type B).
II. After mutual agreement between the transferring and receiving enterprises regarding the bonded goods circulation (equipment transfer), the enterprises should, in accordance with the requirements of General Administration of Customs Announcement No. 23 of 2018, submit a bonded declaration list. The following columns in the declaration list should comply with the requirements of this announcement:
(I) Fill in the list type as ordinary list
(II) The associated list number should be filled in by the transferring enterprise with the corresponding import bonded declaration list number of the receiving enterprise.
(III) Fill in the associated filing number with the filing number of the counterpart's hand (account) record.
(IV) When conducting equipment transfer, the supervision method should be filled with "equipment entry and exit zone" (supervision method code: 5300).
III. The consolidation and comparison of the transferring and receiving bonded declaration lists are based on the 10-digit commodity codes. If the commodity codes are consistent and the statutory quantities are the same, the comparison is considered successful. In cases where system comparison is unsuccessful, a consolidation and comparison are conducted based on the first 8 digits of the commodity codes. If the commodity codes are consistent and the statutory quantities are the same, the comparison is considered successful, and it is subject to manual verification otherwise.
If the commodity codes do not match or the statutory quantities differ, the transferring bonded declaration list is rejected. The transferring and receiving parties shall negotiate and, based on the negotiation results, make corresponding modifications or cancellations to the bonded declaration lists.
In case of disagreements between the transferring and receiving parties regarding the commodity code for the same product, the commodity code determined by the receiving Customs based on the relevant classification rules shall prevail.
IV. After both the transferring and receiving bonded declaration lists have been approved, the companies can proceed with the actual shipment and complete the customs release procedures at the checkpoints according to relevant requirements.
V. In accordance with the provisions of the "Announcement of the General Administration of Customs of the People's Republic of China No. 23 of 2018" on simplifying customs declaration procedures for bonded goods, companies involved in the transfer may be exempted from the customs declaration procedures. Special requirements for customs declaration should be handled in accordance with specific regulations.
VI. When conducting equipment transfer, the receiving company should apply to the competent Customs for adjusting the monitoring period end date of the equipment sub-account.
VII. The procedures for the transfer of bonded goods (equipment transfer) between the special Customs supervision areas, bonded logistics centers, and processing trade enterprises outside the zones, as well as other bonded supervision places, should be handled in accordance with the above regulations.
VIII. This announcement shall be implemented from July 1, 2018. Customs that have conducted pilot projects before July 1 can follow this announcement. Announcement No. 86 of 2016 by the General Administration of Customs is hereby abolished.
